iDEA Submits Comment Letter to North Dakota Governors Office

The North Dakota governor is in the process of renegotiating a compact with the state’s gaming tribes. As part of that agreement they are including language that would allow tribes to offer state-wide mobile sports and iGaming.

But unlike Michigan, Connecticut and Arizona, the proposed compact follows the Florida model, which has been challenged in the courts and is causing a considerable delay and uncertainty because the courts have ruled that online gaming authorized pursuant to a compact is not permitted under IGRA.

We submitted this letter on Monday, October 31. The purpose of our comments is to inform the Governor’s office of the potential legal pitfalls of their current approach, and to caution them that by doing so, they will likely slow down any launch of sports betting and iGaming in the state. Our goal is to have them reconsider this approach to legalization and instead work with the legislature to establish a more clear pathway for tribes (and others) to offer legal online sports betting and iGaming.
