OH: OCCC Passes Batch 2
Batch 2 of the rules passed out of the Casino Control Commission and are now on their way to the Common Sense Initiative (CSI) office for review.
Once they are given the green light, they’ll move on for legislative review. If any of the rule batches hit snags in the review process, Batch 2 and Batch 5 are the best candidates because they both deal with Type A and B licensing and operating issues.

Should fixes or corrections be needed for the sports betting legislation, they would need to be passed before the June break. Should the items not be amended until lame duck session, they will either require an emergency clause to go into effect immediately, or sports betting will launch with the current provisions in place.
iDEA continues to engage with the Ohio Casino Control Commission during the regulatory process and we submitted comments on proposed Batch 5 rules on 03/18.
Our OH lobbyist, had a conversation with Rep. Bill Seitz, one of the House managers of sports betting legislation, about possible items for cleanup legislation to be passed in the spring. Changes to the “incremental economic benefit” concept, including broadening the employment provision in current rules and specific consideration of the payment of a license fee, are on the table. Another concept being looked at for changes is the tax language regarding the carryover of negative balances rather than making the tax liability zero on that particular day. Taking a look at the applicant/”person” language and the corporate ownership issues is also on the table.
